Why Radio Recall Doesn't Reprint From Major Dailies

From time to time, contributors will send us OTR clippings found in their local newspaper. However getting authorization to reprint is not only very expensive, but the hoops you have to jump through, designed by their legal counsel divisions, make the whole process more than annoying.

A typical example of this is set forth below, regarding an obituary of Jack Johnstone published in the Los Angeles Times. Not only did the newspaper demand an up-front payment of $ 130 (which is more than we spend on printing an entire issue) but they set forth a litany of legalistic requirements as part of the sale. Their closing admonishment even attests that the Times, in "its sole discretion" may issue a "cease and desist" order should they feel that our use of their material is contrary to what they may have understood from our original request.

So we invite you to peruse this (form) letter from the L.A. Times, written by their legal team. (Radio Recall made this request five years ago, so the $130 fee is probably up to $150 today.) So now you know why you never saw this Johnstone obituary in RR. ++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++

Dear Mr. French:

Thank you for your letter in which you request permission to reprint material from the Los Angeles Times, "Jack Johnstone; Long career in radio drama," written by Burt A. Folkart that published December 2, 1991.

LAT Reprints charges a not for profit fee of $130.00 for one-time, nonexclusive permission to use the above mentioned text in your newsletter, "Radio Recall," with a print run of up to 150 copies that will publish in your May 2011 issue.

We require payment for your request prior to granting permission. If you would like to proceed with this request, please submit this letter along with a check for the appropriate amount. Please make check payable to LAT Reprints and mail to:

Credit card payments should be faxed to 213/237-6515 (private fax) for immediate attention. All fees are due prior to the release of any material or granting of permission and are not refundable.

This letter does not grant you permission to use the requested material. Upon receipt of payment, I will send you a letter setting forth the terms of the permission for use to be granted by the Los Angeles Times. An authorized individual must sign that letter, agreeing shall be bound by all the terms of the permission. Upon my receipt of the signed agreement to all the terms, the permission will be considered granted.

Client shall have the right to translate text but shall not translate it in any way that alters the meaning, tone or general context of the material or which renders material libelous or in any way is a violation of the rights of any third party of any applicable law, regulation or rule. LAT Reprints shall have the right but not the obligation to approve any or all translations of the material.

Should the Los Angeles Times in its sole discretion, determine the use of our material by you, the client, is contrary to the original intent as we understood it in your letter requesting permission, we reserve the right to demand that you cease and desist in your use of Times material and remove it from the marketplace.
